Sunscreen in the US is no longer handled the way it once was. A 2021 FDA rule moved most OTC sunscreens from drug status to cosmetic status under the FD&C Act, but that reclassification came with binding requirements: the product must meet performance standards and carry specific mandatory label elements to be marketed legally.
A tinted formula stacks a second obligation on top of that. The color part — the pigment that gives primer and foundation effect — is a color cosmetic. Its colorants must be listed, compliant and within permitted use. The sun protection part must be supported by testing and stated in a defined format. One product, two rule sets, and one label that has to satisfy both at once.
The EU adds a third wrinkle: the PA rating. The PA++++ figure on a product like this is a UVA-protection tier determined under ISO testing, and it is expected on the EU pack. It is not a claim you print on a US label. That single difference is why many brands keep two regional label files for one formula.

Under the 2021 FDA sunscreen framework, a legal US label for a broad-spectrum product must state the SPF, the "Broad Spectrum" claim, the sunburn/prevention purpose, and the full ingredient information, with zinc oxide declared as the active sunscreen ingredient. The FDA publishes the current standards and labeling rules for over-the-counter sunscreens.

The product description uses "liquid zinc" to describe the zinc delivery approach. "Liquid zinc" is not an INCI or regulatory ingredient name. On the label, the active must appear as zinc oxide. If your supplier markets a liquid-zinc process, that is a formulation story for your brand narrative — the INCI and active-ingredient declarations still use zinc oxide, and the supplier should document the process on request.
Under the 2021 monograph, zinc oxide used as a sunscreen active must meet the non-nano cosmetic-grade standard. If the formula uses a liquid-zinc technology, confirm the material is documented as non-nano so the label claim stays defensible.
Because this is a tinted serum, the pigment is regulated on the color-cosmetic side. Every colorant must have a correct INCI name, be within permitted use, and appear in the ingredient list in the right order. A tinted formula therefore needs a slightly more careful ingredient review than a clear sunscreen, because a missing or mis-ordered colorant is a real compliance finding — not a cosmetic typo.

The difference that surprises buyers most is the PA line. PA++++ is the highest UVA tier under ISO 24443, and EU consumers expect to see it. Do not carry it onto the US label, and do not drop it from the EU label — they are separate files for the same product.
You cannot print "SPF 30" because the filters look strong on paper. The number has to be earned by testing.
In vivo testing on human subjects is the recognized route, run to ISO 24444 under standardized conditions. The measured value must support the labeled number. If the formula tests at 35, labeling it "SPF 30" is the safe, conservative choice — you never label above what the data supports. This is the ISO 24444 method referenced by both regulators.
The PA tier comes from the UVA protection factor, tested under ISO 24443. PA++++ sits at the top of the PA / PA+ / PA++ / PA+++ scale and indicates the highest UVA protection band. Keep the SPF claim as low as your data comfortably supports. It is far easier to step the label up on a later batch than to explain a claim you could not substantiate. And because the PA rating is an EU line, make sure your supplier can provide the UVA test data to match it, not just the UVB/SPF data.
